Why having no trespassing sign is a must!
The Department of Justice and Correctional Services has drafted a statement to replace the Trespass Act which will prohibit unlawful entry on premises:
- Property owners need to give notice by either putting up clear signage or giving an oral warning to the perpetrator - that indicates that entry is prohibited.
- If somebody unlawfully gains access to an enclosed property without permission from the property owner are found guilty of an offence.
- Trespassers can defend against the charge if there is a reasonable belief that they have title or interest on the premises that entitles them to enter.
- It is presumed that access to the door of the property is not prohibited if you've provided the means to access it.
To summarise, having a "no trespassing" sign on your property becomes highly important for legal protection. A "no trespassing" sign provides you with the ability to prosecute anyone who enters your property without your permission.
